End User License Agreement (EULA)

IMPORTANT - READ CAREFULLY

This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and Easy Snake ("Company," "we," "us," or "our") for the Easy Snake software product, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("Software").

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.

1. GRANT OF LICENSE

Easy Snake grants you the following rights provided that you comply with all terms and conditions of this Agreement:

Installation and Use: You may install and use an unlimited number of copies of the Software on your devices for personal, non-commercial use.
Backup Copies: You may make copies of the Software for backup and archival purposes.
Home Use: You may install the Software on all computers in your household for use by members of your household.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS

2.1 Limitations on Reverse Engineering, Decompilation, and Disassembly

You may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

2.2 Rental

You may not rent, lease, or lend the Software.

2.3 Commercial Use

You may not use the Software for commercial purposes without express written permission from Easy Snake. Commercial purposes include, but are not limited to, using the Software in a business environment, cyber café, or arcade setting.

2.4 Software Transfer

You may permanently transfer all of your rights under this Agreement, provided you retain no copies, you transfer all of the Software, and the recipient agrees to the terms of this Agreement.

2.5 Termination

Without prejudice to any other rights, Easy Snake may terminate this Agreement if you fail to comply with the terms and conditions. In such event, you must destroy all copies of the Software and all of its component parts.

3. COPYRIGHT

All title and copyrights in and to the Software (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the Software), the accompanying printed materials, and any copies of the Software are owned by Easy Snake. The Software is protected by copyright laws and international treaty provisions. You must treat the Software like any other copyrighted material.

4. DISCLAIMER OF WARRANTY

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EASY SNAKE DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. EASY SNAKE DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.

5. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EASY SNAKE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF EASY SNAKE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Easy Snake and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees) arising from your use of the Software.

7. PRIVACY AND DATA COLLECTION

The Software does not collect, transmit, or store any personal information. High scores and game preferences are stored locally on your device only. For more information, please review our Privacy Policy.

8. UPDATES AND MODIFICATIONS

Easy Snake reserves the right to modify, suspend, or discontinue the Software at any time with or without notice. Easy Snake may also impose limits on certain features or restrict your access to parts or all of the Software without notice or liability.

9. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Los Angeles County, California.

10. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and Easy Snake relating to the Software and supersedes all prior or contemporaneous understandings regarding such subject matter.

11. SEVERABILITY

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
